BCHRT Decision Update: Mask Policy Complaint Proceeds Without Amendments
The BC Human Rights Tribunal recently ruled on our class complaint (CS-006011) against FHA's mask policy, denying both the FHA's request for more complaint details and our request to amend the complaint. This keeps our case focused on the original issue as we move towards a case management conference.
PROCEDURAL UPDATE
The British Columbia Human Rights Tribunal has issued a decision regarding our class complaint. It addressed two applications: one from the Fraser Health Authority (FHA) for more detailed information about our complaint (known as particulars) and our application to amend the complaint by adding more grounds of discrimination and subclasses.
The Tribunal denied FHA's request for additional particulars, indicating the information we've provided so far sufficiently outlines the policy in question. Our application to amend the complaint was also denied, with the Tribunal stating our initial complaint already encompasses the necessary details for the case to proceed.
This decision means our complaint remains focused on the original issue without expansion but clearly outlines FHA's policy's impact on high-risk individuals during the pandemic. The Tribunal's next steps include a case management conference to discuss the progression of our complaint.
